Welcome to Wibto ("we", "our", "company"). These Terms of Service ("Terms") and Privacy Policy govern your access to and use of our mobile and web applications, features, services, technologies, and software (collectively "Services"). By creating an account or using Wibto, you accept these Terms and our Privacy Policy. If you do not accept them, you should not use the Services.

1. Wibto Service

We agree to provide you with the Wibto Service. The Service includes all products, features, applications, services, technologies, and software we provide to fulfill Wibto's mission: To help people socialize by competing in fun and fair ways, share their content, and build communities.

The Service consists of the following elements:

Offering personalized opportunities to create, connect, and share

Every user is different. Therefore, on Wibto, we enable you to create and participate in photo or video-based tournaments, earn points, and interact with communities. We continuously improve our systems to help you more easily reach content, tournaments, and people you're interested in.

Developing a positive, inclusive, and safe environment

Providing an environment that all our users can enjoy is our priority. We have teams, community guidelines, and technologies to combat harmful, deceptive, or abusive behavior. When necessary, we may share information (for example, in case of abuse) with relevant authorities. For more information, please refer to our Privacy Policy.

Continuing to provide ongoing service to the growing community

Wibto uses modern technologies (e.g., artificial intelligence, machine learning) to serve its expanding global community. These technologies are necessary for organizing content, ensuring security, and delivering personalized experiences.

Delivering consistent and flawless experiences

Wibto operates its technologies in an integrated manner to ensure users have a seamless interaction between mobile (iOS/Android) and web experiences. You can obtain a secure and consistent experience across all platforms through your user account.

Providing access to our Service

Enabling you to connect with content, brands, and communities you care about

Wibto develops systems to show you content and tournaments that may be interesting to you. Additionally, we work with third-party business partners and may display sponsored content or advertisements. We strive to make this content as relevant as your other experiences on the platform.

We use the information we collect in continuous research and development efforts to make Wibto safer, more fun, and more efficient. Additionally, we may collaborate on projects that benefit the community.

2. Revenue Sources for Our Services

You can use Wibto free of charge at a basic level. However, we have different ways of generating revenue to ensure the sustainability of our Service and to provide you with better experiences:

Advertisements and sponsored content

Wibto allows businesses and brands to display their advertisements or sponsored content on the platform. These advertisements and sponsored tournaments are selected to be relevant to you and presented as a natural part of your Wibto experience.

Use of personal data

To show you more relevant advertisements, your activities on the platform (e.g., tournaments you participate in, content you like, your region) may be taken into account. However:

We do not sell your personal data.
Information that directly identifies you (e.g., your name, email address) is not shared with advertisers without your permission.
Only anonymized and aggregated data is shared with advertisers (e.g., general demographic information, tournament participation statistics).

Premium memberships

Wibto offers its basic services free of charge. Additionally, a Premium Membership option is available to enhance users' experiences. Premium membership can provide advantages such as additional features, advanced personalization, ad-free use, or access to special tournaments. Premium membership is paid, and pricing, payment terms, and cancellation rights are clearly specified separately.

Transparency and control

We offer you the ability to manage your settings so you can have control over the advertisements and sponsored content shown to you. This way, you can limit advertisements recommended based on your interests or opt out of some personalized content.

3. Privacy Policy

We need to collect and use your information to provide our Service. The Privacy Policy explains how we collect, use, and share information across Wibto products.

You must accept the Privacy Policy to use Wibto.

4. Eligibility and Account Requirements

You must meet certain eligibility requirements to use Wibto. Our Services are not intended for children under 13 years of age.

If you are under 13 years of age (or the minimum legal age in your country), you cannot use Wibto. In this case, we will delete your account and all your data.
If you are between 13-18 years of age, parental or guardian consent is required for you to use the Services.
By using Wibto, you represent that you have the legal capacity to accept these Terms.

Additionally, you confirm that you have not been convicted of a sexual offense, that you are not prohibited by law from using our services, and that your account has not been previously closed for violating our policies.

If you are using Wibto on behalf of a business, organization, or legal entity, you confirm that you have the authority to bind that legal entity and accept that the term "you" in these Terms covers both you as an individual user and the legal entity you represent.

5. Your Account

You are required to provide accurate, current, and complete information when registering.
It is your responsibility to maintain the confidentiality of your account information.
You may not sell, transfer, license, or assign your account, username, or account rights.
Wibto reserves the right to remove or reclaim usernames that violate someone else's intellectual property or are inappropriate.
If you believe your account has been used without authorization, you must inform us immediately.

6. Content You Share

Wibto allows you to create and share photos, videos, text, tournament participation, rankings, and other content ("User Content").

There will be no change regarding your rights to your content. You retain ownership of the content you share. However, when you upload content, you grant Wibto and its affiliates a non-exclusive, international, global, royalty-free, transferable, and sublicensable license (legal permission). This license includes the right to host, store, use, display, reproduce, edit, publish, analyze, distribute, promote, and use content covered by intellectual property rights (such as photos or videos) for any purpose necessary for operating the Services.

This license also covers third-party service providers working with us.

Depending on your settings, other users may also view, share, or interact with your public content.

This license ends when your content is deleted from our systems. You can delete your content individually or all at once by deleting your account.

7. Prohibited Uses

You may not use Wibto for illegal, misleading, or fraudulent purposes. The following behaviors are prohibited:

Impersonating others
Making harmful, hateful, or violent posts
Violating others' rights
Using automated bots or data scrapers
Disrupting or attempting to damage the Services
Distributing malicious software
Engaging in harassment, bullying, or sexually explicit content
Violating any applicable laws

Violations may result in suspension or termination of your account and, if necessary, legal action.

8. Security and Community Guidelines

We want Wibto to be a safe and positive community. Therefore:

Harassment, threats, hate speech, violence, obscene content, spam, misinformation, and other harmful behaviors are prohibited.
We reserve the right to review, remove, or report content that violates policies.
Repeated or serious violations may result in permanent closure of your account.
In cases of legal requirement, we may notify authorities.

9. Data Charges and Devices

Using Wibto may be subject to data charges by your mobile operator or internet provider. You are responsible for these charges.

Notifications, account alerts, and updates related to the Service may be sent to you via email, SMS, or push notification.

By providing your phone number or email, you agree to receive such messages (you can disable promotional messages at any time).

10. Intellectual Property

Wibto and its licensors own all intellectual property rights to the Services, software, trademarks, logos, designs, and all other intellectual property.

You are only granted the usage rights specified in these Terms.

You may not copy, modify, distribute, sell, or reverse engineer Wibto's intellectual property without permission.

11. Paid Services

Some features on Wibto may be paid or require a subscription.

By making a purchase, you agree to pay the specified fee and comply with the relevant payment terms.

Fees are non-refundable (unless required by law).

Wibto reserves the right to change prices or introduce new fees (notification will be provided when legally required).

12. Account Termination

You can delete your account at any time from the application settings.
Wibto may suspend or close your account if you violate these Terms, commit fraud, or your account poses a security risk.
When your account is terminated, your license to use the Services ends. However, provisions regarding intellectual property, liability, indemnification, and dispute resolution remain in effect.

13. Disclaimer and Limitation of Liability

Wibto is provided "as is" and "as available."
We do not guarantee that we will provide uninterrupted or error-free service.
We do not commit that content will always be accurate, safe, or appropriate.
To the extent permitted by law, Wibto and its affiliates cannot be held liable for indirect, special, incidental, or punitive damages (loss of profit, data loss, etc.).
Our total liability for any claim will not exceed €100 or the amount you have paid to Wibto in the last 12 months, whichever is higher.

14. Our Agreement and Provisions Applicable in Case of Dispute

14.1 Our Agreement

Additional terms may apply to specific parts of the Service or related features (e.g., payment transactions, premium memberships, sponsored tournaments). These additional terms will be communicated to you separately and become part of this agreement. In case of conflict, additional terms take precedence.

If any provision of this agreement is invalid or unenforceable, the remaining provisions remain valid.

Changes to the agreement can only be made in writing by Wibto. Our failure to enforce any provision does not mean we have waived that right.

All rights not expressly granted to you belong to Wibto.

14.2 Entitled Persons

This agreement does not grant direct rights to third parties.

Users cannot transfer their rights and obligations under this agreement without Wibto's written consent.

Wibto may transfer its rights and obligations to third parties (e.g., due to company merger, sale, restructuring, or legal requirement).

14.3 Limitation of Liabilities

The Service is provided "as is." We do not guarantee that the Service will always be error-free, uninterrupted, secure, or completely meet your expectations.

Wibto, to the extent permitted by law, disclaims all express or implied warranties, including merchantability, fitness for a particular purpose, ownership rights, or non-infringement.

We are not responsible for the behaviors, posts, or content of users or third parties. We cannot be held liable for third-party services you access through Wibto.

Our liability for direct or indirect damages, loss of revenue/profit, data loss, or incidental damages that may arise from use of the Service is limited to the minimum level permitted by law.

14.4 Dispute Resolution

If you are a consumer, the laws of the country where you reside will apply to disputes arising from this agreement. You may bring your claims in competent consumer courts.

If you are a commercial user (e.g., business, institution, advertiser, agency), any claims arising from or related to this agreement will be resolved solely under the exclusive jurisdiction of the courts of England and Wales. This agreement is subject to the laws of England and Wales.

However, in cases of product abuse or unauthorized access, Wibto may, if it chooses, bring the dispute to a competent court in the country where the user resides.

14.5 User Feedback and Suggestions

Suggestions, ideas, or feedback provided by users are important to us. However, they may be used without any compensation obligation, and Wibto has no obligation to keep them confidential.

15. Updating These Terms

We may update these Terms from time to time as we develop our Service and policies. Updating the Terms may be necessary to accurately reflect the operation and principles of our Service.

Notification: Unless legal requirements dictate otherwise, we will inform you before any changes take effect (for example, through in-app notification, email, or via our website).

Review opportunity: Before the updated Terms take effect, users will have the opportunity to review the changes.
